Change 3 to HUD Handbook 4350.3 Now Available

In early July of 2009, the U.S. Department of Housing and Urban Development (HUD) posted the transmittal and affected pages for Change 3 to HUD Occupancy Handbook 4350.3. Read the transmittal detailing where and what changes have been made and the handbook in its entirety (with the incorporated page changes, posted by chapter).

As indicated in the transmittal, “changes are designated by an asterisk (*) at the beginning and ending of the change, and Chg-3 is in the header, with the date 06/09 at the bottom of each affected page. Chapter 9 is re-issued in its entirety.” The changes are effective Aug. 1, 2009.

A preliminary review of the transmittal confirms significant changes recently referred to and reported on from the article on June 2009 TRACS/Industry meeting, including:

  • Income reduction for "federal pensions" for divorced/separated people in Change 2 extended to "state, local government, military and SS/SI pensions."
  • Removal of the requirement to obtain resident signatures prior to Gross Rent changes (however, signatures must still be collected within 60 days if actual resident payment and/or utility allowances change apply).
  • Clarification that, when no new certification is completed for an existing by the 15th month, HUD will terminate subsidy and will then require the site to return the three months of unsubstantiated rental assistance payments.

Chapter 9 now reflects the significant revisions to the HUD 50059, the addition of the 50059-A, and to incorporate the various changes made with TRACS 202C.
